Please carefully read these conditions of sale for Alybeara, which apply to all purchase orders. If you do not wish to comply with these terms and conditions of sale, you should immediately cancel your order.
Registration:
You agree to provide us with accurate and complete information, including your legal name, address and telephone number. You warrant that any credit card or bank account information you provide is accurate and that you have the right to use the account.
You authorize us to process the order total on the credit card your present, and you acknowledge that that you have read and agree to abide by the terms regarding returns and refunds.
Name on Bank/Credit Card Statement.
You acknowledge that the name on your credit card, bank or PayPal statement will be Marketing Department.
Sales Tax:
If you reside in the State of Texas, we add 8.25% sales tax to the order.
Payment:
We accept Visa, MasterCard, Discover Card, American Express, PayPal, check and money order.
Use of Products:
All information, content and product descriptions contained within this site is for reference purposes and is not intended to substitute advice given by a pharmacist, physician, or other licensed health-care professional. You should not use this information for treating a health problem or disease or to make a self-diagnosis. Contact your Veterinarian Health Care provider immediately if you suspect that your pet has a medical problem. Actual product packaging may differ than that shown on this website. Our products are provided "as is" without warranty of any kind, either expressed or implied, except as indicated by the manufacturer. In no event shall our juridical person be liable for any damages including, but not limited to, direct, indirect, special, incidental or consequential damages or other losses arising out of the use of or inability to use our products.
Antifraud Check:
Customer purchase can be suspended for manual antifraud check for 10-20 minutes as well as it can be suspended for longer term (around 20 hours) for more serious investigation. Antifraud check occurs because of growing number of fraud transactions from persons who are not actual cardholders of the credit cards used during purchase.
Online Catalog Product Specifications:
Products purchased through our online catalog shopping system are limited to the specifications defined by the store. An option for a custom pricing is available.
Special Orders:
To place a special order for an item or service not currently listed on the website, please contact us for pricing.
Notices.
Pricing and description errors.
Although our staff of proofreaders works diligently to ensure the accuracy of copy descriptions and prices, we reserve the right to correct typographical, descriptions and photographic errors. Orders based on incorrect information can be cancelled or returned.
Product measurements may not be exact. Sizes shown are close approximations. Photographs are of the products available at the time of upload. Items may be updated, or models of equal or better value may be substituted. Product depictions on packaging may vary slightly from the actual product because of updating or because several models of a product in one sytle box. Verify the size and colors as pictures shown are for use as examples only.
Substitutions for out of stock items.
No substitutions are made unless it is the same item with new packaging that has been updated. The same model of equal or better value may be substituted. Substitutions for similar items will be made if requested by purchaser.
Notice of Claims.
If in our judgment the sale or use of any of our products may be found to infringe the property rights of a third party or presents a consumer safety hazard, we may, at our option, require you to return the infringing products for a merchandise credit or exchange.
Fire Notice and Caution.
When electrical products are used, take care to avoid causing a fire hazard or harm to pet. Take all precautions to use in a safe manner.
Shipping:
At Alybeara, we rely on 3rd party shipping services. Rates calculated in real time based on weight of product and destination. Please allow time picking/packing based on time of day order received CST in addition to the shipping timeframes shown in your shopping cart. Minimum weight for all products includes packing materials and boxes used.
Guarantee and returns:
You agree to use our online Request Return Authorization process. You understanding that depending on the item, the customer who made the purchase has 10 or 30 days to make a request to return an item. Seasonal items and perishables typically have 10-day return window. We cannot accept returns for personal care items, such as vitamins and flea and tick products, as they cannot be resold. Items for return must be in original packaging and in good condition suitable for resale. Items returned that are not in the original condition suitable for resale do not qualify refund and the item is discarded. We do not refund or cover the cost of shipping.
Restocking Fee Breakdown:
20% Restocking Fee: Pet Beds, Dog Houses, Pet Ramps, Booster Bath, Booster Bath Ramps, Pet Gates, Doggie Dooley, Crates, Cages, Pens and Kennels,Exercise Pens, Pet Barriers, Pet Strollers. All products not listed above are subject to a 10% restocking fee.
Warranty Exclusion.
WE ARE NOT LIABLE FOR ANY LOSSES, COSTS OR DAMAGES ARISING DIRECTLY OR INDIRECTLY FROM YOUR PURCHASE, THE SERVICES WE PROVIDE OR THE SALE OF OUR PRODUCTS. NO WARRANTY OR REPRESENTATION, EXPRESS OR IMPLIED, AS TO MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE IS GIVEN OR ASSUMED BY ALYBEARA OR ITS PARENT, AND ALL SUCH WARRANTIES, REPRESENTATIONS AND TERMS ARE HEREBY DISCLAIMED AND EXPRESSLY EXCLUDED. NO ADVICE OR INFORMATION GIVEN BY ALYBEARA OR ANY OF OUR REPRESENTATIVES SHALL CREATE ANY WARRANTY.
Damage Limitation.
OUR CUMULATIVE LIABILITY TO YOU FOR ANY AND ALL CLAIMS RELATING TO OR ARISING OUT OF YOUR PURCHASE/MEMBERSHIP SHALL NOT EXCEED THE TOTAL AMOUNT OF THE PURCHASE PRICE YOU HAVE PAID TO US FOR THE ITEM(S). ALYBEARA AND ITS PARTNERS, AFFILIATES AND PARENT SHALL IN NO EVENT BE LIABLE FOR ANY PUNITIVE OR CONSEQUENTIAL DAMAGES, OR LOST PROFITS, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES, AND EVEN IF ANY EXCLUSIVE REMEDY PROVIDED FOR IN THIS AGREEMENT FAILS OF ITS ESSENTIAL PURPOSE.
Miscellaneous.
If one or more provisions of these Rules shall be held to be invalid, illegal, or unenforceable, the validity, legality, and enforceability of the remaining provisions shall not be construed as a waiver.
Notices:
All changes and amendments to these conditions of sale may be updated from time to time. When an update occurs, notices will be posted on this website and may be submitted to registered members. Disputes that cannot be settled within 30 days shall be submitted for binding arbitration to the local office to be determined by company of the American Arbitration Association. Client and company agree that these terms and conditions are a binding agreement on their respective personal and business heirs and assigns and shall be interpreted according to the laws of the State of Texas, USA.
Acceptance:
By submitting order, client agrees to the conditions of sale set forth, and agrees to be legally bound as defined, by continuing to process the order. Our company reserves the right to change or modify these terms with no prior notice.
